Website registration terms and conditions

Interest in being considered as an entrant to the Tournament (as that term is defined below) may be registered only one of two ways – by registration on our website, subject to the terms and conditions applicable to "Entrants via Website", or by invitation, subject to the terms and conditions applicable to "Entrants via Invitation".

Different criteria may apply to the process for Entrants via Website vs Entrants via Invitation, however the same Minimum Entry Requirements, Selection process, and terms and conditions of the Tournament and Tournament Prize shall apply equally to all successful applicants.

1. ("Registration Process") Individuals wishing to register their interest to be considered as an entrant into the Investec Structured Products Golf Tournament (the "Tournament") as an Entrant via Website will need to enter their personal details when prompted to do so via our website. When these details have been entered into the system by the entrant, the individual will be automatically registered on our system for consideration by the Investec Structured Products selection team (the "Selection Team"). The Registration Process will close on midnight on Friday 2 March 2012 (the "Closing Date") and all registrations on the website made after this time will not be considered.

2. (''Eligibility Criteria'') To be eligible to register your interest pursuant to the Registration Process and so to have a chance to participate, you must be a UK FSA authorised financial adviser and supply your FSA number when prompted to do so. The Tournament is only open to UK FSA registered financial advisers, aged 18 years and over and will not be open to employees and immediate families of Investec or anyone professionally connected with the Tournament or the organisation of the Tournament.

3. (''Minimum Entry Requirements'') In addition to the Eligibility Criteria set out in paragraph 2 above, there is also a maximum club handicap requirement of 24 and the Tournament itself will be based on a three quarters handicap system. Investec reserves the right to check the accuracy of your registered handicap with your specified golf club/ house as detailed on your registration form, and exclude you from the Tournament in the event it is unable to satisfy itself as to the accuracy of that handicap. All qualifiers from the regional events will be required to produce a valid club handicap certificate prior to the Final (as that term is defined in the Tournament Terms and Conditions (attached)).

4. ("Other Entry Restrictions") Only one entry per person will be permitted and Investec reserves the right to cap the number of applicants from each organisation at its sole discretion. Investec reserves the right having received all registrations of interest (from Entrants via Website and Entrants via Invitation) to further restrict or extend these Other Entry Restrictions and the Selection process (as that is defined below) as may be necessary to manage Tournament capacity, in its sole discretion.

5. ("Selection") The Selection Team will be responsible for the selection of the Tournament competitors (the "Competitors"). The decision will be at the Selection Team's absolute discretion and any decision made by the Selection Team will be final and binding. Investec will not enter into any correspondence in respect of the Selection Teams' selection of the Competitors.

6. ("Notifications") We will let you know whether or not you will compete in the Tournament within 4 weeks of the Closing Date.

7. (The "Tournament Prize") The ultimate winner of the Tournament will win an expenses paid two-night break (subject to a £600 cap on food and drink expenditure incurred during your stay) on Friday 10 and Saturday 11 May 2013 at the 5-star luxury Old Course Hotel, St Andrews, including two rounds of golf (including one round being on the Old Course itself) for the winning Competitor and a fellow adviser of the Competitor. There is also a luxury spa experience for the partners of the winning Competitor and a fellow adviser. There is no alternative to the Tournament Prize and the dates are not transferable to any alternative date regardless of the circumstances. In the event that the ultimate winner is unable to take the Tournament Prize on the date specified the prize will lapse. Full details of the Tournament Prize will be provided to the overall winner of the Tournament and may be subject to change. The second prize will be a custom made set of golf irons plus a golf bag. The third prize will be a 'Scotty Cameron' putter. These prizes will also be non-transferable.

8. (The "Tournament") Competitors will be subject to the Tournament Terms and Conditions. Competitors will also be subject to the individual terms and conditions of each golf course played at during the Tournament as the same apply to visitors.

9. ("Travel Costs") Cost of travel to and from the regional qualifiers of the Tournament are not covered by Investec and will be borne by each Competitor. It will be the Competitor's responsibility to make his/her own travel arrangements. In the event you qualify to compete in the Final at Turnberry, you will be required to make your own way to Glasgow at your own cost. From there, transfers to Turnberry will be provided.

10. ("Investec's Website Terms and Conditions") You agree that Investec's website terms and conditions apply to your use of the Investec website and you hereby acknowledge and agree to these website terms and conditions.

11. ("Investec's Privacy Policy") Any personal data inputted by you onto Investec's site as part of the Registration Process will be dealt with by Investec in accordance with its Privacy Policy as published on its website. Where as part of the Registration Process you provide the personal data of another individual, you should ensure you have their permission to do so, and that they understand we will treat their data in accordance with our Privacy Policy. Investec agrees at all times to only process your personal data in accordance with the provisions of the Data Protection Act 1998.

12. ("Liability") Investec will not be liable for any costs or losses incurred by you whether in contract, tort or otherwise in the event that the Tournament, or any part of it, is cancelled due to circumstances which are outside of Investec's reasonable control. Where possible, Investec will seek to re-arrange. Investec will not be liable to you for any direct loss, indirect or consequential loss, loss of profit, loss of business or any other damage suffered by you except that Investec will be liable for any personal injury or death which has been caused by the negligence of Investec. You agree to the exclusions and limitations of liability included in this paragraph 12 on the basis that your participation in the Tournament will be provided, excluding the cost of travel, at no cost whatsoever to you.

13. ("Governing Law") These terms and conditions will be governed and interpreted in accordance with English law and will be subject to the jurisdiction of the English courts.

Tournament terms and conditions

1. (the "Tournament") The Tournament will run from Tuesday 17 April 2012 to Wednesday 5 September 2012 and will be spread over 13 regional golf courses throughout the UK. The winners will be announced at each regional qualifier tournament day. The two top finishers from each regional qualifier plus the next ten best regional qualifiers from throughout the Tournament will go on to play in the final that will take place on Thursday 27 September 2012 at the Ailsa Course, Turnberry ("Final"). If you are unable to attend the Final, you will lose your place and Investec will select the next ranked players from the Tournament regional qualifiers.

2. ("Travel Costs") Cost of travel to and from the regional qualifier's of the Tournament are not covered by Investec and will be borne by each Competitor. It will be the Competitor's responsibility to make his/her own travel arrangements. Each competitor that qualifies for the Final will be required to make their own way to Glasgow, from where transfers to Turnberry will be provided.

3. (The "Tournament Rules") The scoring during the Tournament will be based on the Stableford System (using three quarters handicap) and 18 holes will be played. If there is a tie, the system to calculate the winner of each regional event and the final will be as follows: Best back 9 nine hole countback; if still a tie best last 6 holes countback; if still a tie best last 3 holes countback and if still a tie the best score on the last hole. If at this point the top two players are still tied the following will be applied: Regional qualifiers – top two players will qualify as first and second for the final. Tournament Final – to award first, second and third, the top two players (and / or, if necessary, the next top two players) will compete against each other in a "penalty shootout" which will be won by the player that gets nearest the pin after three shots. In the event of a qualifier or the final being stopped due to bad weather then an overall score will be taken over the number of holes completed by all the field, (with a minimum 6 holes). If less than this is played or no holes are played then a suitable date will be found to replay the event.

4. ("Disqualification") Investec reserves the right to disqualify a player from the Tournament at any time where Investec considers such action to be appropriate in the circumstances or where it is requested to do so by an individual golf course. Investec's decision to disqualify a Competitor will be binding and final and Investec will not enter into any correspondence in connection with its decision in this regard.

6. (The "Golf Club T&C's") Competitors will be subject to the individual terms and conditions of each golf course played at during the Tournament as the same applies to visitors.

7. (''Media/ Press'') You acknowledge that Investec may wish to use publicity resulting from the Tournament, and by entering the Tournament you irrevocably consent to be filmed and/or photographed and you agree to your name, footage and photography being used and appearing in Industry publications and websites and/or published on our Website (www.investecstructuredproducts.com).

8. ("Liability") Investec will not be liable for any costs or losses incurred by you whether in contract, tort or otherwise in the event that the Tournament, or any part of it, is cancelled due to circumstances which are outside of Investec's reasonable control.
